RESPONSIBLE USE POLICY

This Responsible Use Policy (the "Policy") is incorporated by reference into our Terms of Service. It applies to all users of and visitors to the Services - including users on free trials, evaluation accounts, and invited Organization seats - whether or not you have a paid subscription. Any violation of this Policy is a breach of our Terms of Service.
This Policy applies to any and all:
- Uses of our Services
- Forms, materials, templates, report formats, parsing workflows, and all other content available on the Services ("Content")
WHO WE ARE
We are Cubic Insights LLC ("Company," "we," "us," or "our"), a company registered in Florida, United States at 216 N 2nd St, Fernandina Beach, FL 32034, USA. We operate the website https://www.provenflight.com (the "Site"), as well as any other related products and services that refer or link to this Policy (collectively, the "Services").
USE OF THE SERVICES
When you use the Services, you warrant that you will comply with this Policy and with all applicable laws. You may use the Services for your internal business and professional purposes, including maintaining flight records, flight logs, and related aviation documentation for yourself or your Organization.
You also acknowledge and agree that you may not:
- Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
- Circumvent, disable, or otherwise interfere with security-related features of the Services, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Services and/or the Content contained therein.
- Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services, or any portion of the Services.
- Engage in any automated use of or access to the Services - including the use of any bot, script, spider, robot, scraper, offline reader, or other data mining, gathering, or extraction tool - except as may result from standard search engine or Internet browser usage or through an integration we have approved in writing.
- Collect usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or create user accounts by automated means or under false pretenses.
- Interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services.
- Engage in unauthorized framing of, mirroring of, or linking to the Services.
- Engage in any use - including modification, copying, redistribution, publication, display, performance, or retransmission - of any portion of the Services or the Content, other than as expressly permitted by this Policy and our Terms of Service, without the prior written consent of Cubic Insights LLC, which consent Cubic Insights LLC may grant or refuse in its sole and absolute discretion.
- Copy or adapt the software comprising or in any way making up a part of the Services, or decipher, decompile, disassemble, or reverse engineer that software, or reconstruct or attempt to discover any source code or algorithms of the Services, or any portion thereof, by any means whatsoever, except to the limited extent applicable law expressly prohibits this restriction.
- Access or use the Services if you are a competitor of ours, or on behalf of a competitor of ours, or use the Services or the Content to develop, train, improve, or market a product or service that competes with the Services, including by using the Services for competitive benchmarking or analysis or to monitor their availability, performance, or functionality for competitive purposes.
- Use the Services or any Content, or any data obtained from the Services, to develop, train, fine-tune, evaluate, or improve any artificial-intelligence or machine-learning model, or for text- or data-mining, or make the Services or Content available to any third party for such purposes, without our prior written consent. Nothing in this bullet restricts a customer from using its own Customer Data (as defined in our Terms of Service), including exported Customer Data, for its internal purposes, including research and analysis.
- Resell, sublicense, white-label, or otherwise provide or make available the Services to any third party, use the Services on a service-bureau basis, or share seats, accounts, or login credentials to circumvent the purchase of the Services.
- Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material that interferes with any party's uninterrupted use and enjoyment of the Services or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Services.
- Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats ("gifs"), 1×1 pixels, web bugs, or other similar devices (sometimes referred to as "spyware" or "passive collection mechanisms").
- Attempt to impersonate another user or person or use the credentials of another user.
- Trick, defraud, or mislead us or other users, especially in any attempt to learn sensitive account information such as user passwords.
- Intercept any data not intended for you, or damage, reveal, or alter any other user's data, or any other hardware, software, or information relating to another person or entity.
- Use any information obtained from the Services in order to harass, abuse, or harm another person.
- Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Services to you.
- Make improper use of our Services, including our support services, or submit false reports of abuse or misconduct.
- Delete the copyright or other proprietary rights notices from any Content.
- Use the Services in a manner inconsistent with any applicable laws or regulations.
CONSEQUENCES OF BREACHING THIS POLICY
We may take any action we deem appropriate in response to any breach of this Policy, based on factors such as the severity of the breach and your history on the Services. These actions include, without limitation, issuing a warning, suspending or terminating your access to and use of the Services, and disabling your account. Our remedies are cumulative: we may pursue any remedy available to us at law or in equity - including injunctive relief and claims for infringement or misappropriation - whether or not we have first given a warning or taken any other action, and no delay or graduated response waives any of our rights or remedies. We may also notify or refer conduct to law enforcement where we consider it appropriate, including where we believe there is a risk to any individual or to public safety.
To the fullest extent permitted by law, we exclude our liability for actions we take in response to breaches of this Policy.
